§1 By sending the order, the Buyer confirms
that he/she is an adult and fully legally capable of contracting.
§2 Our offers shall be non-binding and
subject to delivery by our own suppliers. An entitlement of the Buyer to any
order quantity shall not apply. Compensation in the event of late delivery shall
be excluded, in so far as no gross negligence exists on our side. The acceptance
of your order shall be effected by dispatch of the goods. The order confirmation
dispatched via the Internet when you ordered shall still not be an acceptance of
contract.
§3 You will receive your ordered goods - if
currently in stock - within 7 working days, but in any case as quickly as
possible. If we should request a deposit or advance payment, the delivery dates
may be postponed. In the event of non-compliance with the delivery date, you
shall be entitled to terminate the contract in writing. Claims for compensation
for delay or non-compliance shall be excluded, in so far as no gross negligence
exists on our side.
§4 If it should ever happen that an ordered
item does not correspond to your wishes, you have 14 days' time from receipt to
return it. The prompt return shall suffice for compliance with the deadline. A
justification for the return shall not be required. In the event of the valid
exercising of this right of return, compensation may be claimed in the case of
impairment of the goods. This shall not apply if the impairment of the goods is
attributable exclusively to their examination - as would have been possible for
you in the pharmacy, for instance. In addition, you may avoid the obligation to
compensation, if you do not put the goods into use as an owner and refrain from
everything that impairs their value. If you make use of your right of return,
the contract becomes void.
§5 A warranty of 2 years shall apply unless
the manufacturer of the product has indicated a specific use-by date on the
goods.
§6 The delivered goods shall remain in the
ownership of the Seller up to the payment in full. Payment in the trade shall be
possible with MasterCard, Eurocard, Visa or AmEx card, by cash on delivery, cash
in advance and by direct debit (only applies for customers approved by us with
an Apocard). In the case of delivery to other public pharmacies and members of
healing professions, payment on account shall be possible. In the event that the
periods of credit are exceeded, we shall retain the right to charge interest for
default amounting to 5% above the base rate.
§7 The Buyer shall bear the costs of
dispatch.
§8 You have to bear the costs of return if
the delivered goods correspond to the ones ordered and if the price of the
object to be returned does not exceed an amount of EUR 40 or, in the case of a
higher price for the object, if you have not yet provided the consideration or a
contractually agreed partial payment on the date of the cancellation.
§9 We shall process the personal data
disclosed by you solely for the purpose of executing a purchase agreement
concluded with us by you. Dissemination to third parties for other purposes
shall be excluded.
§10 The law of the Federal Republic of
Germany shall apply. The place of performance and legal venue shall conform with
the registered office of the pharmacist in Berlin. Deviating terms and
conditions of business shall require written confirmation on our
part.
